1. About these terms

These Terms of Service ("Terms") govern your use of the theaoura online store (the "Store") and any purchase you make on it. The Store is owned and operated by Partython Private Limited, a company incorporated in India with its registered office at No. 5, 2nd Street, Devi Nagar, Ayapakkam, Chennai, Tamil Nadu 600077, India (GSTIN 33AANCP1567D1ZH) ("Theaoura", "we", "us", "our"). Theaoura is a brand of Partython Private Limited.

By accessing the Store or placing an order you agree to these Terms, our Privacy Policy, Shipping Policy, Returns, Exchange & Refund Policy, Payment Policy and Cancellation Policy, which form part of these Terms.

2. Eligibility and account

You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872 to place an order. If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please provide accurate and complete information.

3. Products, colours and sizing

  • We make every effort to display products, colours, fabrics and measurements accurately. Actual colours may vary slightly depending on your screen and lighting. Handcrafted techniques such as block printing, embroidery and handloom weaving may show small irregularities that are part of the product's character.
  • Size charts are provided as a guide. Please refer to our Size Guide and the product page before ordering.
  • All products are subject to availability. We may limit quantities or discontinue products at any time.

4. Pricing and taxes

  • All prices are in Indian Rupees (₹) and are the Maximum Retail Price (MRP) inclusive of all taxes including GST.
  • Shipping is free on all orders within India.
  • If a product is listed at an incorrect price because of a typographical or technical error, we reserve the right to cancel the order and refund the full amount to your original payment method, even after confirmation.
  • A GST tax invoice is issued for every order.

5. Orders and payment

  • Placing an order is an offer to purchase. A contract is formed when we dispatch your order and send you a shipping confirmation.
  • Theaoura is a 100% prepaid store. We do not offer Cash on Delivery (COD). Orders are accepted only after successful online payment through our RBI-authorised payment gateway partners (UPI, debit/credit cards, net banking and wallets). See our Payment Policy.
  • We may refuse or cancel any order, for example where a product is out of stock, a pricing error has occurred, the delivery pincode is not serviceable, or we suspect fraudulent or unauthorised activity. In every such case you will receive a full refund to your original payment method.

6. Shipping, exchanges, refunds and cancellations

Shipping, exchanges, refunds and cancellations are governed by our Shipping Policy, Returns, Exchange & Refund Policy and Cancellation Policy.

7. Promotions and offers

Discount codes and offers are subject to their stated terms, cannot be exchanged for cash and may be withdrawn at any time. Only one code may be used per order unless stated otherwise.

8. Intellectual property

All content on the Store, including the THEAOURA name, the crowned swan logo, the tagline "Be Brave, Be Her.", designs, photographs, text and graphics, is owned by or licensed to Partython Private Limited and is protected by Indian and international intellectual property laws. You may not copy, reproduce, modify or commercially use any content without our prior written permission.

9. Acceptable use

You agree not to misuse the Store, including by attempting unauthorised access, introducing malicious code, scraping content, placing fraudulent orders, posting unlawful or offensive content, or infringing anyone's rights.

10. Reviews and communications

If you submit reviews, photos or feedback, you confirm they are genuine and your own, and you grant us a non-exclusive, royalty-free licence to use them in connection with the Store and our marketing. We may remove content that is false, offensive or unlawful.

11. Third-party links and services

The Store may link to third-party websites or use third-party services (such as payment gateways, couriers and WhatsApp). We are not responsible for their content or practices, and your use of them is subject to their own terms.

12. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential losses. Nothing in these Terms limits any rights you have as a consumer under the Consumer Protection Act, 2019.

13. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, government action or courier disruptions.

14. Governing law and disputes

These Terms are governed by the laws of India. Subject to your statutory rights as a consumer, the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction. We encourage you to first contact our customer care team or Grievance Officer so we can resolve any concern amicably.

16. Changes to these Terms

We may update these Terms from time to time. The version published on the Store at the time of your order applies to that order.
